AGREEMENT TO TERMS
By accessing OmniBioFex.Cloud, you agree to these Terms of Service, our Privacy Policy, and the upstream Health AI Developer Foundations (HAI-DEF) Terms of Use governing the MedGemma 1.5 4B IT model.
DISCLAIMER & LIABILITY WARNING
OmniBioFex.Cloud and MedGemma 1.5 4B IT are NOT clinical-grade.
Outputs are not intended to directly inform clinical diagnosis, patient management, treatment recommendations, or direct clinical practice. All outputs must be independently verified by a licensed medical practitioner before any real-world decision.
1. NOT A MEDICAL DEVICE
OmniBioFex.Cloud and its underlying MedGemma 1.5 4B model are provided strictly for educational and research purposes. The platform is not cleared by the FDA, CE, or any regulatory body for clinical diagnostic use.
NO CLINICAL USE
Users must not utilize platform outputs to dictate patient treatment, diagnosis, or medication regimens. All algorithmic inferences must be independently verified by a licensed medical practitioner.
NO REGULATORY CLEARANCE
OmniBioFex.Cloud is not FDA-cleared, not CE-marked, and not approved by any equivalent regulatory authority in any jurisdiction. It has not undergone clinical validation studies.
PRELIMINARY OUTPUTS
All model outputs should be considered preliminary and require independent verification, clinical correlation, and further investigation. Never rely solely on model output for any decision.
2. SERVICE TIERS & PAYMENTS
All service tiers grant access to the same underlying model — google/medgemma-1.5-4b-it and its DICOM variant. Differences are limited to quota, priority, and integration surface.

3. USER OBLIGATIONS
You agree to use OmniBioFex.Cloud responsibly and in compliance with all applicable laws, the HAI-DEF Prohibited Use Policy, and the obligations below.
NO IDENTIFIABLE PHI
DO NOT upload images containing identifiable Patient Health Information (PHI) unless strictly anonymized and legally permissible under your jurisdiction.
NO REVERSE ENGINEERING
DO NOT attempt to reverse engineer, extract weights from, or otherwise compromise the Vertex AI inference pipeline or the underlying MedGemma model.
NO UNAUTHORIZED RESALE
DO NOT utilize the API for commercial resale, white-labeling, or as part of a competing product without a separate Enterprise agreement.
NO PROHIBITED USES
DO NOT use the service for illegal activities, harmful content generation, unauthorized professional practice, or generating deceptive content — as defined by the HAI-DEF Prohibited Use Policy.
NO AUTOMATED ABUSE
DO NOT script bulk account creation, scrape the interface, or otherwise abuse free-tier quotas. We monitor for anomalous usage patterns.
ACCURATE INFORMATION
You agree to provide accurate authentication information via Google OAuth. Impersonation or falsified identity may result in immediate termination.
4. HAI-DEF GOVERNANCE
MedGemma 1.5 4B IT is governed by the Health AI Developer Foundations Terms of Use (last modified November 15, 2024) and the Health AI Developer Foundations Prohibited Use Policy. Your use of OmniBioFex.Cloud is subject to those upstream terms.
KEY GOVERNANCE POINTS
- HAI-DEF recipe source code, model inference code, model training code, utility code, and other source code deliverables are licensed under Apache 2.0.
- Distribution of HAI-DEF or Model Derivatives requires inclusion of use restrictions and a copy of the Agreement.
- Users must not use HAI-DEF for prohibited uses, including illegal activities, harmful content, unauthorized professional practice, or generating deceptive content.
- Google will not claim ownership over original outputs generated using HAI-DEF.
- The services are provided "AS IS" without warranties. Google is not liable for damages arising from use.
- California law governs disputes between you and Google, resolved in Santa Clara County courts.
5. INTELLECTUAL PROPERTY
YOU RETAIN OWNERSHIP
You retain all rights to the medical files and prompts you upload. You grant OmniBioFex.Cloud a limited, ephemeral license to process them solely for the purpose of returning model output.
GOOGLE DOES NOT CLAIM OUTPUTS
Consistent with HAI-DEF terms, Google does not claim ownership over original outputs generated using MedGemma 1.5 4B IT. You are free to use outputs subject to these Terms and applicable law.
OMNIBIOFEX RETAINS RIGHTS
The OmniBioFex.Cloud interface, branding, design system, and orchestration layer are owned by VantyrixTek and protected by applicable intellectual property laws.
6. LIMITATION OF LIABILITY
OmniBioFex.Cloud, VantyrixTek, and their respective officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
MAXIMUM LIABILITY
To the maximum extent permitted by law, our total liability is capped at the amount you paid in the twelve months preceding the claim.
For free-tier users, this cap is $0 USD. The service is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
7. TERMINATION
TERMINATION BY YOU
You may terminate your account at any time by contacting privacy@omnibiofex.cloud. Wallet balances are non-refundable, but remain associated with your account for future reactivation within 12 months.
TERMINATION BY US
We reserve the right to suspend or terminate access for violations of these Terms, the HAI-DEF Prohibited Use Policy, or abusive behavior. Free-tier abuse results in a permanent ban.
EFFECT OF TERMINATION
Upon termination, your stored JSON outputs are deleted within 30 days per our Privacy Policy. Sections 5, 6, 8, and 9 survive termination.
8. GOVERNING LAW & DISPUTES
OMNIBIOFEX GOVERNANCE
These Terms are governed by the laws of India. Any dispute arising from use of OmniBioFex.Cloud shall be resolved in the courts of competent jurisdiction in India, without regard to conflict-of-law principles.
HAI-DEF GOVERNANCE
Disputes concerning the MedGemma 1.5 4B IT model itself are governed by California law and resolved in Santa Clara County courts, per the HAI-DEF Terms of Use.
9. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time. Material changes will be announced on the main page and reflected in the "Last updated" date at the top of this page. Continued use of OmniBioFex.Cloud after changes constitutes acceptance of the revised Terms.
